The arraignment is generally the first time a defendant appears in front of a criminal court judge. In the State of Washington a defendant’s presence is required for a DUI arraignment hearing. A prosecutor representing the government will also be present.

During this arraignment three issues will be recorded:

  • Notice—The formal complaint will be read. This is not the time for the defendant to make any statements or wage a defense.  Attorneys do the talking during this procedure.
  • Conditions of release—After a plea of not-guilty the judge will determine whether or not to impose bail. If a defendant cannot post bail, then he or she will sit in jail throughout the duration of the criminal case. This can take between 30 to 180 days. At this time the judge can make other stipulations. These can include such things as the installation of an ignition interlock device or mandatory AA meetings.

An evaluation of how much of a flight risk you are will help determine the amount of bail set by the judge. Whether injury was caused by the defendant’s action will also be taken into consideration.

  • Future court date notice—During the DUI arraignment, the last thing which should occur will be the scheduling of the next court date. You shouldn’t leave the arraignment until you know exactly when the court expects to see you again. A bench warrant will be issued if you fail to attend a scheduled court hearing.
