Often when parents decide to divorce, they expect that there is a strict formula to determine child support when the children resides with both parents.  Some people call this the “residential credit.”

More than a decade ago Washington law had a residential credit. This has changed. Courts no longer use the strict residential credit to calculate child support. The residential credit formula was repealed in 1991; one year after it was enacted.  Recent court decisions have actually ruled the old formula in error.

Instead the deviation for residential time alone is discretionary. The court has discretion to deviate from the standard calculation. When determining the amount of the deviation, the court normally considers increased expenses to a parent who is making support payments because the child is spending more time with that parent. The court also considers the decreased expenses to the parent the other parent.

The “deviation” is based on the totality of the circumstances and it’s not suppose to leave a parent with insufficient funds.
