There are some advantages to getting an annulment that aren’t there if you get a legal divorce or dissolution of marriage. In Washington State annulments are legally called Declaration Concerning Validity of Marriage. Not everyone qualifies for a “Declaration Concerning Validity of Marriage” or annulment.
In order to qualify for an annulment, one of the involved parties must meet the following criteria. These include:
- One person is already legally married.
- One person was underage without parental consent.
- At least one person was not legally competent to agree to the marriage. This could include mental illness or physical disability.
- One person agreed to the marriage under duress.
- One person lied to the other person to convince that individual to get married.
- Bigamy.
If you qualify for an annulment, here are advantages:
- No worry about property division because judges normally assign all property and debts back to the original owner as it was prior to the marriage.
- Any debt amassed during the marriage is split evenly.
- An annulment can release parties from a prenuptial agreement.
- Both parties can legally get remarried.
